Terms of Service

These Terms govern your use of xenoware.xyz and the software it distributes (collectively, “the Service”). By creating an account, purchasing a subscription, or running the Xenoware launcher, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Xenoware provides a software tool that interacts with third-party video games. The Service is sold as a time-limited subscription granting personal, non-transferable access to a single user account bound to a single hardware fingerprint (HWID). The Service is provided as is; we make no guarantee that it will work with any particular version of any game, on any particular hardware configuration, or for any particular duration.

2. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to purchase a subscription.
• You are responsible for ensuring that your use of the Service is lawful in your jurisdiction. We do not provide legal advice and do not endorse use of the Service in any way that violates applicable law.
• You must not be a current or former employee of, contractor for, or otherwise affiliated with, any game publisher, anti-cheat vendor, or competing product whose terms of service the Service may interact with.

3. Account & Security

• You are responsible for keeping your account credentials, recovery codes, and refresh tokens confidential.
• You must not share your account with another person. The Service is licensed per-user, per-HWID; an account observed to be used from multiple unrelated machines may be suspended without refund.
• You must enable two-factor authentication if we require it for your account class (e.g. administrators). 2FA is optional but recommended for all customers.
• If you believe your account has been compromised, contact us immediately at support@xenoware.xyz.

4. Acceptable Use

You agree not to:

• resell, sublicense, rent, lease, or redistribute the Service or any part of it, except under our published Reseller Program with a signed reseller agreement in force (see §4.1);
• reverse-engineer, decompile, or attempt to extract source code or cryptographic keys from the launcher, engine, or driver, except to the minimum extent required by applicable law that cannot be contractually waived;
• tamper with, strip, or forge the per-download watermark embedded in the launcher binary;
• attempt to bypass, overload, or attack our authentication, rate limiting, payment, or licensing systems;
• use the Service for any unlawful purpose including but not limited to fraud, doxxing, stalking, or distribution of malware;
• charge back or dispute legitimate charges (chargebacks will result in immediate account termination and may be reported to fraud networks);
• reverse a Steam trade used to pay for a subscription within the 7-day Steam hold window - see §6 below for the consequence;
• use the Service in any way that violates the terms of service of a payment provider (Stripe, CoinRemitter, AssetPay), an authentication provider, or any other third-party platform we integrate with.

4.1 Authorised resellers

We operate a Reseller Program that permits approved third parties to resell the Service. Pricing is uniform across resellers:

• Flat 50% wholesale discount off the prevailing retail price for every approved reseller. No volume tiers, no minimum commitment.
• Customers use the standard Xenoware launcher and dashboard with their own xenoware.xyz account. The launcher binary is not co-branded; the reseller's brand lives on their storefront.

Resellers must:

• be approved in writing and have a current Reseller Agreement with us;
• only sell to end users who themselves agree to these Terms (the reseller is responsible for binding their customers);
• not modify, repackage, or otherwise tamper with the launcher binary, its embedded watermark, or any other Service component;
• route end-user payments through their own payment infrastructure and remit the wholesale price to us per the agreed invoice schedule;
• never resell or transfer their API key - a leaked key results in immediate suspension of the reseller account.

Sales outside an active Reseller Agreement are not authorised and are treated as a §4 violation. Full API documentation is at /docs/reseller; to apply, complete the form at /reseller or email resellers@xenoware.xyz.

5. Subscriptions, Payments & Renewals

• Subscriptions are sold for fixed terms (1 day, 1 week, 1 month, 3 months). Subscription time stacks: purchasing a second subscription before the first expires extends the end date rather than starting a parallel one.
• Prices are denominated in EUR for card and crypto payments and USD for skin payments. Skin payments carry an additional surcharge to cover processing fees, the Steam-side trade hold, and market liquidity.
• Subscriptions do not auto-renew. You will not be charged a second time without returning to the site and re-purchasing.
• VAT, sales tax, or equivalent indirect tax is included in displayed prices where applicable.

6. Refunds & Trade Reversals

Refunds are governed by our separate Refund Policy. In summary: unused subscriptions may be refunded within 14 days for EU consumers per Article 16(m) of Directive 2011/83/EU; once the Service has been activated, the right of withdrawal lapses and refunds are at our sole discretion.

Reversing a Steam trade used to pay for a subscription within the 7-day Steam hold window constitutes a material breach of these Terms and results in immediate and permanent termination of your account. This applies regardless of the value of the skins involved, the plan you purchased, or whether you had additional active subscriptions through other payment methods. A trade reversal mid-hold is the skin-payment equivalent of a credit-card chargeback, and is treated identically: account locked, license revoked, every active session dropped, forum access removed. 7. In-Game Bans & Detection

This is the most important section. Read it carefully.

Anti-cheat systems used by online games are adversarial and constantly updated. We make no guarantee that the Service will evade detection by any anti-cheat system, current or future, in any game. Use of the Service may result in temporary or permanent bans, equipment bans (HWID bans), inventory loss, account confiscation, or other consequences imposed by game publishers.

You accept all such consequences as your sole risk. We do not refund subscriptions on account of in-game bans, account losses, or anti-cheat updates that affect Service compatibility.

8. License Grant & Termination

We grant you a personal, non-exclusive, non-transferable, revocable license to download and run the Xenoware launcher for the duration of an active subscription on the HWID bound to your account. The license terminates automatically when your subscription lapses, when your account is suspended, or when these Terms are violated. We may terminate your access at any time, with or without notice, for breach of these Terms or for any conduct we reasonably believe is harmful to other users or to us.

9. Availability & Service Changes

We make reasonable efforts to keep the Service available but do not guarantee any specific uptime. We may suspend, modify, or discontinue any part of the Service at any time, including in response to game updates, anti-cheat changes, payment-provider action, or operational necessity. Where a change materially reduces the Service for a paying customer, we will at our discretion offer a pro-rata credit or refund.

10. Disclaimer of Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL XENOWARE, ITS OPERATORS, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, IN-GAME ITEMS, OR GAME ACCOUNTS. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 90 DAYS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited (e.g. for fraud, gross negligence, or death/personal injury caused by negligence).

12. Indemnity

You agree to indemnify and hold harmless Xenoware and its operators from any third-party claim, demand, or expense (including reasonable legal fees) arising out of your breach of these Terms, your use of the Service in violation of applicable law, or your violation of any third party's rights.

13. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced via email or via the dashboard prior to taking effect. Continued use of the Service after a change constitutes acceptance of the revised Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-laws provisions. Subject to your non-waivable rights as a consumer, the courts of Vilnius, Lithuania, have exclusive jurisdiction over any dispute arising out of or relating to these Terms. EU consumers may also use the European Commission's ODR platform at ec.europa.eu/consumers/odr.
